MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding (MOU) is made and entered into as of
August 31, 2004, between the California Department of Fish and Game (DFG)
and the Coarsegold Resource Conservation District (CRCD).
WHEREAS, it is the mission of the DFG to manage California's
diverse fish, wildlife, and plant resources, and the habitats upon which
they depend for their ecological values and for their use and enjoyment by
the public; and
WHEREAS the DFG has acquired ownership of approximately 508
acres of the property known as the Kinsman Flat Wildlife Area, located off
Minarets Road, approximately 12 miles east of North Fork in Madera County;
and
WHEREAS the property was purchased by DFG for the purpose of
protecting and enhancing habitat for deer and other wildlife; and
WHEREAS the CRCD is a diverse group of local volunteers that
help landowners care and protect their natural resources in a way that
will improve the area's economy, environment and living standards; and
WHEREAS it is the vision of DFG and CRCD to work cooperatively
to improve habitat for deer, quail and other wildlife.
THEREFORE permission is granted to CRCD to enter Kinsman Flat
Wildlife Area for the reasons stated above and will remain in effect
through December 31, 2007, unless extended by written agreement.
CRCD agrees to the conditions stated herein:
- Permittee agrees to indemnify and hold harmless DFG, their
employees, agents, and assigns from any loss or damage and from any
liability on account of personal injury, property damage, or claims
for personal injury or death arising out of Permittee's activities
under this MOU.
- Damage done to DFG property shall be promptly corrected at CRCD's
expense and to the satisfaction of DFG.
- This permission given herein shall neither constitute nor be
construed as any surrender of the jurisdiction and supervision of DFG
over the lands described herein.
- The use of and entry onto the subject lands will be for access by
CRCD and their agents and employees.
- The CRCD will contract for low impact mechanical crushing and
piling. Manipulated species will be designated on the ground by
CRCD representatives under direction from the DFG. Burns will be
accomplished in cooperation with the USDA Forest Service and
California Department of Forestry and Fire Protection. This
project will improve habitat for deer, quail and other wildlife.
It will involve selectively crushing and piling mature and decadent
brush in the spring or early summer. Brush piles will be burned
the following year after deer migration. Mechanical brush
removal will be accomplished using a low impact rubber tract excavator
equipped with a mechanical thumb and weighing less than 8,000 pounds.
