COOPERATIVE CONSERVATION AGREEMENT

BETWEEN THE

COARSEGOLD RESOURCE CONSERVATION DISTRICT

AND

THE U.S. DEPARTMENT OF THE INTERIOR

BUREAU OF LAND MANAGEMENT
BAKERSFIELD FIELD OFFICE

 

This MEMORANDUM OF UNDERSTANDING (MOU) is hereby entered into by and among the Coarsegold Resource Conservation District, hereinafter referred to as CRCD, and the U.S. Department of the Interior, Bureau of Land Management (BLM), Bakersfield Field Office, hereinafter referred to collectively as BLM.

A. PURPOSE

The purpose of this agreement is to facilitate cooperative community conservation, education and outreach efforts between the BLM and the CRCD, to enhance, restore, and protect local watershed values, air, soil, cultural and natural resources on public and private lands within eastern Madera County, California. The parties shall promote conservation and education activities by providing for local public participation in the decision process, in accordance with respective agency missions, policies and regulations.

It is understood that this agreement establishes a basis for cooperation and assistance between the parties to achieve common natural and cultural resource goals and objectives. Authority to carry out specific projects or activities, such as the transfer of funds, acquisition of services and property will be carried out under separate documents.

B. STATEMENT OF MUTUAL BENEFITS AND INTERESTS

The BLM and the CRCD share a common mission to sustain the health, diversity and productivity of the public lands and private lands for the use and enjoyment of present and future generations. The parties agree to share information, equipment, personnel as appropriate to implement best management practices and projects that meet the mutual missions of the BLM and CRCD and the public interest. Projects may include vegetative management to improve watershed values and create fire-safe communities and enhance public access to recreational opportunities.

The BLM provides opportunities for environmentally responsible recreation on the public lands it manages. Both BLM and CRCD agree to promote environmental ethics programs such as Leave No Trace and Tread Lightly in all visitor services programs, and outreach materials.

The BLM and CRCD have a common interest in ensuring the long-term sustainability of natural and cultural resources by using interpretation to help public land users make an emotional connection to the resources and better understand how public land resources affect their daily lives. The BLM and CRCD recognize that high quality interpretation can help build community-based stewardship through increasing the public’s understanding and appreciation for natural, heritage and commodity resources and the mission and management practices of both parties.  BLM and CRCD agree to work together and combine resources wherever possible, to enhance and expand opportunities for education, interpretation and outreach programs in the region.

C. GENERAL PROVISIONS

The BLM and CRCD agree that:

Nothing in this agreement may be construed to obligate the Department of the Interior, or the United States, to any current or future expenditure of resources in advance of the availability of appropriations from Congress. Any endeavor involving an agreement for reimbursement or contribution of funds between the parties to this MOU will be handled in accordance with applicable laws, regulations, and procedures, including those for Government procurement and printing. Such endeavors or agreements will be outlined in separate agreements that shall be made in writing by representatives of the parties and shall be independently authorized by appropriate statutory authority.

Nothing in this agreement may be construed to obligate the CRCD to any current or future expenditures without approval, in writing.

BLM and CRCD shall develop an Annual Operations Plan to determine projects and actions to be accomplished each year.

D: TORT LIABILITY

BLM and CRCD each assume responsibility for their officials, employees, volunteers, and contractors acting within the scope of their employment to the extent provided by federal, state, tribal or local laws.

E. TERMINATION

This agreement can be modified at any time by mutual written consent of all parties. Either party may terminate this agreement by notifying other party in writing, 60 days prior to termination.
